What Requirements Are Needed For Adoption in Oklahoma?

Beginning the process of adoption is always a special time. However, the joy you may feel could be clouded by the stress of legal paperwork and documents.

While some parents may have previously adopted a child in a different state, they may not be aware that each state has its requirements and laws for adoption. Let’s dive in and find out more about the adoption requirements in the state of Oklahoma.

Who Can Adopt in Oklahoma?

In Oklahoma, anyone over the age of 21 can adopt. It doesn’t matter whether they are single or married. However, all those who wish to adopt must first be approved through an Oklahoma licensed home-study professional.

They must also complete a home study. The home study is a basic overview of your life to determine if you have a stable environment in which a child can be raised.  You will have to submit background checks, agree to home visits, undergo family interviews, and complete certain courses.

What Requirements are Necessary For Adoption?

Unless the parents of the child are deceased or have terminated their parental rights, those seeking adoption must try to get consent from the birth parents before the adoption can take place.

If the adopting parents are married, both husband and wife must complete the process together. This can get a bit tricky, as sometimes one of the parents is the birth parent of the child. Even if this is the case, both parents need to join in on the adoption.

In the case that a stepparent is wishing to adopt a child, they need to be married to the birth parent for a minimum period of one year. It’s important to note that any child over the age of 12 must also give their consent to the state of Oklahoma to be considered for adoption.

What Legally Happens After Adoption?

After adoption, all legal rights between the birth parents and the child have been terminated. The birth parents no longer have any rights to information or whereabouts of the child. The adoptive parents are now viewed as the natural parents of the child. They are now expected to provide a permanent home for their child and care for their physical, emotional, and mental needs.
